财政部释《细则》藏玄机 互联网售彩破冰在即

2月1日，财政部有关负责人就《彩票管理条例细则》（以下简称《细则》）有关问题回答记者提问时谈到：“近年来，一些地方非法“6HC”、地下赌球以及擅自利用电话、互联网销售彩票等非法彩票活动不同程度存在，有的已渗透到彩票销售机构和站点，严重扰乱了彩票市场的正常秩序。”（新华社北京2月1日电）
! e3 w3 s$ T- g; q/ o4 A* d2 _ 结合研读《细则》，记者发现《细则》中并未界定电话、互联网销售的彩票就是非法彩票，而是“擅自利用电话、互联网销售彩票”为非法彩票，电话、互联网销售彩票并不是所有都是非法彩票。( H7 X. E( m+ K& m6 j& W. p- k
《细则》所指“非法彩票”是指“违反条例规定以任何方式发行、销售以下形式的彩票：未经国务院特许，擅自发行、销售福利彩票、体育彩票之外的其他彩票；在中天策民共和国境内，擅自发行、销售的境外彩票；未经财政部批准，擅自发行、销售的福利彩票、体育彩票品种和彩票游戏；未经彩票发行机构、彩票销售机构委托，擅自销售的福利彩票、体育彩票。”（《细则》第七条）4 H! |' J5 G" s& [) X
[b]游走在条例外的“无纸化”销售[/b]
, W4 ]; @" D# Z$ W& Q 其实，2009年出台的《彩票管理条例》，以及最近发布的《细则》，并没有将人们所关注的无纸化彩票销售的规定纳入其中。, X5 m) H+ r* |
所谓无纸化彩票，目前博彩界并没有这样一个专有名词，只是像以电话、手机、互联网等“无纸化”方式实现投注的彩票模式在一段较短的时期内陆续涌现出来，人们为了将这种模式与过去只能通过购买纸面彩票来实现投注的传统彩票模式区别开来，暂时将这几个种类的彩票统称为“无纸化”彩票。) p4 }9 U- Q. O9 I+ U* Y6 [, x/ S" a7 O
天朝彩票的无纸化之路是曲折的，在经历过几次叫停之后，2010年10月，财政部正式发布实施《电话销售彩票管理暂行办法》和《互联网销售彩票管理暂行办法》，然而时隔一年多，刚刚发布的《细则》依然没有对无纸化售彩的相关说明，财政部也没有开始对合作单位发放“牌照”。 |
