2006年6月29日，十届全国人大常委会第二十二次会议通过了《刑法修正案（六）》，该修正案将“开设娱乐城”从原来以营利为目的的Dubo犯罪行为中分立出来，作为一种特别的犯罪行为规定，并将刑罚从原来的三年有期徒刑提高到十年。2007年10月25日，最高人民法院、最高人民检察院将开设娱乐城犯罪的罪名确定为开设娱乐城罪。聚众Dubo与开设娱乐城均是Dubo罪中常见的客观表现行为，均有为Dubo提供场所、赌具等物质便利条件的行为，在实践中往往难以区分，正确区分行为人的行为是聚众Dubo还是开设娱乐城，对被告人准确定罪量刑具有十分重要的意义，笔者认为从以下几个方面分析还是能看出二者的区别：
) L7 v7 m$ p2 }9 I: q; C从Dubo的时间上看，聚众Dubo的时间一般具有临时性、短暂性的特点，一般情况下，组织参赌人员在一次Dubo结束后，下一次Dubo又须组织者再次组织；而开设娱乐城的时间具有持续性和稳定性特点，即娱乐城在持续长时间内连续、不间断地为Dubo人员开放，只要在其开放的时间内，Dubo人员来到娱乐城均能进行Dubo活动，而无须娱乐城经营者临时组织、通知。
4 p+ x! E6 V! a$ m& g5 W从Dubo的场所上看，聚众Dubo的场所通常具有不固定性，即聚众Dubo的行为发生场所通常不固定，有的是在临时租赁、借用的房屋或者自己家中进行，有的是临时在宾馆里开房进行，有的甚至在公共场所进行；而开设娱乐城的Dubo场所一般具有固定的营业地点和场所。
9 |( F U( s( i( i! h从Dubo的规模上看，聚众Dubo的规模一般较小；而开设娱乐城的规模一般较大，其营业场所大，Dubo的工具齐全，Dubo的方式多样，有专门为娱乐城服务的人员。
1 ^0 x- M- E: u4 b: C* A9 ?% q从Dubo公开的程度上看，聚众Dubo一般具有隐蔽性，即组织者通常是在小范围内组织他人参赌，在每一次聚众Dubo行为中其成员相对固定，其Dubo行为一般只有组织者、参赌者和为Dubo服务的人知晓；而开设娱乐城一般具有半公开性，即娱乐城开设的时间、地点、性质等被一定社会范围内的公众知晓。7 b0 s. q9 s+ F9 u
从赌头是否参赌上看，聚众Dubo的赌头往往会利用其人际关系和人际资源来召集、组织每一次的具体Dubo活动，本人有时会参与Dubo；开设娱乐城的经营者一般情况下不亲自参与召集、组织人员参与Dubo，其本人一般不会参与Dubo。 |
