我国内地开办网上代购彩票业务的网站至少超过100家，这些网络彩票代售是否合法？天朝律协知识产权专业委执委、北京信息网络法律事务专业委员会主任李德成就《互联网销售彩票暂行办法(征求意见稿)》进行全面解读。
4 B; {; l7 r) E6 N y 记者：目前天朝内地开办网上代购彩票业务的网站至少超过100家，国家曾对此进行叫停，但仍不停卖，目前的网络彩票代售是否合法？有无正确的法规来规范管理？! Y( G2 h% @* |* x
李德成：[b]我不认为，目前网络彩票代售行为是违法的。因为，称其为违法，没有法律依据。[/b]目前，财政部正在制定《互联网销售彩票暂行办法》。按照征求意见稿的规定，未经财政部审批，任何单位不得开展互联网销售彩票业务。

李德成：没有统一的定义，按照《互联网销售彩票暂行办法(征求意见稿)》的规定，是指使用浏览器或客户端等软件，通过互联网、移动通信网等信息网络方式销售彩票。
N# V7 }* L7 B% o) G4 t, S 记者：彩票中心是做什么的，是彩票发行机构吗？征求意见稿，对彩票发行机构从事网络销售彩票业务，有什么规定，您怎么看？
% h) \: @' i- O3 L5 C2 h6 u 李德成：[b]彩票发行机构，是国务院民政部门、体育行政部门依法设立的，分别负责全国福利彩票、体育彩票的发行和组织销售工作的机构，比如国家体育总局体育彩票管理中心。各省、自治区、直辖市还依法成立了负责本行政区域的福利彩票、体育彩票销售工作的彩票销售机构。[/b]
) e8 a2 ]# w R8 Y+ j7 e" e 征求意见稿第8条，规定了彩票发行机构开展互联网销售彩票业务的，应当根据彩票管理条例，经民政部、体育总局同意，报财政部批准。并在第9、10、11、12条就批准所需的条件，流程、材料以及管理等做出规定。
% b6 q$ c& S3 k. l! @1 M; |) C 我认为，征求意见稿的上述规定，没有上位法的依据，有违背《行政许可法》相关规定之虞。+ ~, O# Y- e) ?& b4 q
因为，根据国务院制定的《彩票管理条例》的规定，财政部关于彩票发行的行政许可的内容有三类，即彩票发行机构申请开设、停止或者变更彩票品种。如果要将这三类行为扩大解释，把彩票发行机构开展互联网销售彩票业务也包括在内，这应当是国务院或者国务院法制办来解释。民政部无权对此做出解释，或者说其解释无效。并且根据《行政许可法》第十六条的有关规定，“法规、规章对实施上位法设定的行政许可作出的具体规定，不得增设行政许可；对行政许可条件作出的具体规定，不得增设违反上位法的其他条件。”《互联网销售彩票暂行办法(征求意见稿)》是部门规章，无权增设行政许可。所以，征求意见稿中的上述规定，其法律效力存有争议。这个问题要引起注意。 |
