北京东城审理两大网络赌球案涉案近千万

据天朝之声《新闻晚高峰》报道，北京东城区人民法院今天上午连续开庭，审理两大网络赌球刑事案件，涉案金额近千万。
: ~" \2 s$ w: u" G7 G) f9 ^ 公诉机关指控，被告人的行为涉嫌开设DC罪。! d# ~3 g. [" K- Q& p) r
公诉人：经依法审查查明，被告人刘峰于2010年2月到4月间，在北京市顺义区，利用太阳城DB网站代理账号，为他人提供DB账号、密码及DB额度，发展参赌会员并接受投注共计人民币四百三十多万元。本院认为：被告人康某无视国法，为DB网站担任代理并接受投注，其行为触犯了《中天策民共和国刑法》第三百零三条第二款之规定，犯罪事实清楚，证据确实充分，应当以开设DC罪追究其刑事责任。
% [+ N% v7 A0 g+ w 另一起案件中，被告人康斌在担任太阳城和金沙两个DB网站代理期间，采用同样手段接受投注，金额总计为人民币五百二十四万多元。5 L% X+ a/ R# m' p( a
被告人刘某接受公诉人讯问时表示，他与其他的会员是朋友关系，他没有从中“抽水”。

庭审中，被告人对一些涉及到具体投注数额的证据提出异议，康斌的辩护人申请对被告人的电脑进行重新鉴定，同时认为适用的罪名不当，应当使用DB罪。
( F# c% f9 |+ ?& G9 C2 g8 [ k 辩护人：根据《最高人民法院最高人民检察院关于办理DB刑事案件具体应用法律若干问题》的解释第二条，以盈利为目的而为计算机网络担任代理的，属于刑法规定的开设DC罪，而被告人在网上DB是为了消遣娱乐，并非以盈利为目的。
6 H& E) d9 |$ Z 公诉人认为被告人在法庭承认，开设帐号的目的就是为了和他人一起从中获取10%的利益，仍坚持起诉开设DC罪。
7 J% r! F, G: w' n7 G1 i1 _ 法庭对两个案件都没有当庭宣判。我国刑法规定：以营利为目的，聚众DB、开设DC或者以DB为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。情节严重的，处3年以上10年以下有期徒刑，并处罚金。对被告人如何定罪，要依据最后法院认定的涉案数额。 |
