北京东城审理两大网络赌球案涉案近千万

据天朝之声《新闻晚高峰》报道，北京东城区人民法院今天上午连续开庭，审理两大网络赌球刑事案件，涉案金额近千万。! G6 |8 v; ]* q2 a
公诉机关指控，被告人的行为涉嫌开设DC罪。
# ]1 C/ m4 r3 n 公诉人：经依法审查查明，被告人刘峰于2010年2月到4月间，在北京市顺义区，利用太阳城DB网站代理账号，为他人提供DB账号、密码及DB额度，发展参赌会员并接受投注共计人民币四百三十多万元。本院认为：被告人康某无视国法，为DB网站担任代理并接受投注，其行为触犯了《中天策民共和国刑法》第三百零三条第二款之规定，犯罪事实清楚，证据确实充分，应当以开设DC罪追究其刑事责任。4 a' F- M4 \5 \ J) _
另一起案件中，被告人康斌在担任太阳城和金沙两个DB网站代理期间，采用同样手段接受投注，金额总计为人民币五百二十四万多元。
+ V# o% z, f( V# a被告人刘某接受公诉人讯问时表示，他与其他的会员是朋友关系，他没有从中“抽水”。

3 J d" U; f" G4 q1 g# p3 B 庭审中，被告人对一些涉及到具体投注数额的证据提出异议，康斌的辩护人申请对被告人的电脑进行重新鉴定，同时认为适用的罪名不当，应当使用DB罪。% S4 t7 x3 }1 q5 J3 D$ _+ h
辩护人：根据《最高人民法院最高人民检察院关于办理DB刑事案件具体应用法律若干问题》的解释第二条，以盈利为目的而为计算机网络担任代理的，属于刑法规定的开设DC罪，而被告人在网上DB是为了消遣娱乐，并非以盈利为目的。
0 Y: \( Y& L$ d* q 公诉人认为被告人在法庭承认，开设帐号的目的就是为了和他人一起从中获取10%的利益，仍坚持起诉开设DC罪。7 z4 l3 U/ D0 U
法庭对两个案件都没有当庭宣判。我国刑法规定：以营利为目的，聚众DB、开设DC或者以DB为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。情节严重的，处3年以上10年以下有期徒刑，并处罚金。对被告人如何定罪，要依据最后法院认定的涉案数额。 |
