2010年5月至10月间，唐某（另案处理）等人在晋江青阳街道某酒店游戏机室内，提供具有Dubo功能的游戏机供他人Dubo，并雇佣被告人庄某、黄某、李某等11人分工管理，从中非法牟利。同年10月，警方在游戏机室内查获一组“百家乐”直线连线机、2台“单挑扑克”圆盘连线机、1台“大金鲨”圆盘连线机、1台“动物”圆盘连线机，抓获参与现场管理的被告人庄某、黄某、李某等11人，参与Dubo的刘某等24人，查获赌资7.54万元。经认定，该批电子游戏机全部具有Dubo功能，均为Dubo机。: D. j1 b, L+ |
案发后，上述涉案电子游戏机已被销毁。现场抓获的刘某等24名参赌人员均被罚款。根据庄某等11名被告人在共同犯罪中的地位、作用、时间长短、违法所得或前科情况，予以区别量刑。2011年2月份，庄某等4名被告人被判处有期徒刑一年，并处罚金人民币3万元；李某等3名被告人被判处有期徒刑6个月，缓刑一年，并处罚金人民币2万元；黄某等4名被告人被判拘役6个月，缓刑一年，并处罚金人民币2万元。; t5 e1 A! |7 q) `' y: g, ]" I

C9 s/ z4 w. e$ fDubo机是指具有押分退分、退币、退钢珠等Dubo功能的电子游戏机。Dubo社会危害巨大，极易引起家庭、社会矛盾，滋生盗窃、抢劫、故意伤害等其他犯罪，严重危害社会公共秩序和安全。开设DC罪的范畴业已突破了“搓麻将”、“打扑克”、“班章”等传统的Dubo形式。法律严格规定：凡是以营利为目的，利用固定场所设置单人机型5台、多人机型2台以上Dubo机，供不特定人员参赌的，也应当以开设DC罪依法追究场所出资者、经营者、管理者的刑事责任。由于投资少、见利快，受利益的驱使，一部分经不住诱惑的人在游戏机室内或是公共场所，公然利用电子游戏设施经营Dubo，而一些民众抱着“消遣一下”的态度，沉溺其中，最终血本无归。人们最后得出一个惨痛教训“Dubo机就是电子海洛因”。 |
